Terms and Conditions

Please read these notes thoroughly before using any services from S&P Photos.

1. These Terms and Conditions comprise a binding contract between you as an authorised user of the S&P Photos Online service and S&P Photos for the purchase of photographic prints, and any other goods, E mailed or Uploaded via the Internet or sent to us on a CD or in Film form. By submitting an order, you agree to be bound by these Terms and Conditions. S&P Photos will not be responsible for any loss or damage howsoever arising as a result of a failure on the part of S&P Photos to fulfil an order. The offer and description of this service by S&P Photos does not of itself represent an agreement to accept an order in accordance with these Terms and Conditions. 2. Delivery of Prints All prints will be delivered to the delivery address supplied by you during the registration process (UK delivery only). Your order will be accepted upon submission by you of an offer to buy prints or other goods using the appropriate order facility and upon S&P Photos notifying you by e-mail that your order has been accepted and has agreed to supply the prints or other goods. If your Images or Film are of great value to you, it is your responsibility to take out insurance for any loss or damage that may be caused to them howsoever arrising. If colour matching is required an original print must be supplied by you to S&P Photos. 3. Time for delivery is a best estimate and S&P Photos shall not be liable for any loss or damage arising as a result of late or non delivery of the prints or any other goods. 4. Orders may be refused without explanation and entirely at the discretion of S&P Photos. 5. Price/Specification Postage and packaging where appropriate will be listed separately. S&P Photos shall not be liable for any other taxes or duties that may be imposed upon you and for which you will remain fully responsible. Prices and specifications are subject to change without notice in any circumstances other than where an order has been accepted by S&P Photos. The purchase price is payable in advance by Pay Pal. 6. Returns In the event that you are unhappy with any aspect of our Online Print service, you will be entitled to send the prints back to S&P Photos within 28 days of receipt whereupon S&P Photos will provide a full refund of the purchase price only if S&P Photos are at fault or the supplied goods are faulty. Postage for returns is your responsibility. Statutory rights not affected. 7. S&P Photos will use all reasonable endeavours to prevent any breaches of security including credit/debit card details provided by you and further to use all reasonable endeavours to ensure that any S&P Photos supplier/sub-contractor or agent exercises the same standard of care similarly to prevent breaches of confidence. 8. S&P Photos reserves the right without notice to suspend or alter the operation of its services at its sole discretion and without reason. In such circumstances notice will be provided wherever possible. 9. It is understood that you are solely responsible for the security and use of any user names and passwords needed to access the service or any part of it. 10. You warrant and undertake that you are at least 18 years of age and the authorised owner of the credit/debit card details which you supply to S&P Photos. 11. You warrant that you will not use the service for any fraudulent or illegal purpose, for the transmission or posting of computer viruses or any material which is defamatory, offensive or obscene, and you accept and undertake that you will be liable for any action taken against S&P Photos in relation to such use and will fully indemnify S&P Photos against all actions, claims, demands or costs which may arise as a result. 12. You agree and undertake with S&P Photos that you are the owner of the copyright in any material that you send to us for reproduction. 13. S&P Photos liability to you shall be limited to the sum of £25 for any one incident or series of related incidents and up to a total of £50 for all incidents in any period of twelve months. 14. S&P Photos shall not be liable for any economic loss, profits or anticipated savings, any loss of goodwill and reputation or any loss of data or any consequential loss as a result of breach of contract and/or negligence. 15. Nothing in these Terms and Conditions shall confer on any third party any benefit or right to enforce any term of this Agreement. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these purchase terms. 16. S&P Photos accept no responsibility if the data/original material you provide is not of a good enough resolution/pixel depth for the requested print size. 17. It is your responsibility to ensure your files are correctly sized for the print size you require. S&P Photos accept no responsibility for any cropping that may occur. 18. These Terms and Conditions form the entire agreement between you and S&P Photos and supersede any oral or written communication agreements or other representations. S&Photos reserves the right to add or change these Terms and Conditions at its sole discretion at any time without prior notice. 19. These Terms and Conditions are governed by the laws of England and are subject to the exclusive jurisdiction of the English Courts. 20. All products subject to availability. 21.
